As you look at homelessness, please consider middle-class homeowners who lose their home in common interest developments (CIDs) governed by an association, collectively called a homeowners association (HOA) for this comment.
Homeowners in CIDs/HOAs lose their homes due to displacement caused by unrepaired leaks and the resulting mold.
Homeowners become homeless because of escalating dues and special assessments and lawsuits caused by mismanagement of collective funds.
These realities exist because the HOA governance model does not work.
Most volunteer homeowner association (HOA) boards of directors (BODs) [required by the state] do not have deep financial and business management expertise.
Instead HOA BODs rely on the guidance of the professionals, many of whom have a profit-motive or give advice that protects their company as opposed to protecting individual HOA unit owners, e.g., deny legitimate claims and drag our lawsuits.
This reality plus the fact that Oregon law defaults conflict resolution to the courts are the roots causes of homelessness of former HOA homeowners.
First-time HOA homebuyers, current HOA homeowners and first-time BOD members and newly-elected BOD members all need education on laws, their rights and responsibilities, and best practices. Learn more about the problems at hoareformleaders.com and contact me for solutions.
