NEWPORT — A Lincoln County grand jury has indicted an 18-year-old Waldport resident on charges of raping a minor in early January.
Devan L. LeGrand is in Lincoln County Jail on $250,000 bond after his arrest last week on charges of first-degree rape, second-degree sexual abuse and third-degree rape. The indictment returned Tuesday additionally charges him with furnishing alcohol to a minor.
Prosecutors allege LeGrand forced a victim younger than 16, who was incapable of consent by reason of mental incapacitation and physical helplessness, to engage in sexual intercourse on or about Jan. 1.
The police summary of the charges is not publicly available, as pro tem judge Joseph Allison ordered most court records sealed to protect the identity of the victim. The basic charging document and indictment name the victim by their initials.
The former Waldport High School student is scheduled to be arraigned on the four-count indictment Feb. 13 before Lincoln County Circuit Judge Sheryl Bachart.
Allison ordered LeGrand not to consume alcohol or have unsupervised contact with minors, should he secure bail. He was also ordered not to have contact with the victim or their residence.
