APPLICATION FOR PARTITION

APPLICANT: Owner – Harbor Lights, LLC
Agent – Devco Engineering, Inc.
REQUEST: The applicant requests approval of a 30-lot subdivision of the property located at the northeast
corner of the intersection of SE Shell Avenue and SE South 40 Lane (Tax Lot 941, Map 09-11-
08-AC). The property is approximately 2.40 acres and currently contains three duplex units
permitted under case #2-LI-PC-23. The property does not contain any water resources and is
outside of the floodplain. The property does contain areas of steep slopes which will be required
to be addressed during review. The subdivision will create 30 parcels proposed for townhouse
development. A through-access driveway will serve a portion of the development, connecting to
SE Shell Ave at one end and SE South 40 Lane at the other. Another access point will be located
along SE Shell Ave which will provide access to the remaining portion of the development. All
parcels will be served with City water and sewer. Future construction of townhomes will be
reviewed during the building permit process.

LOCATION: The subject property is located at the northeast corner of the intersection of SE Shell Ave and SE
South 40 Lane, and it is further identified on Lincoln County Assessor’s Map 09-11-08-AC as
Tax Lot 941.
APPLICATION
MATERIALS: Application materials, documents and evidence submitted by or on behalf of the applicant are
available for inspection at City Hall and can be obtained at cost. Documents or evidence submitted
by the applicant after 20 days prior to the hearing constitutes grounds for a continuance of the
hearing if any party requests such a continuance. Copies of the staff report for this case are also
available for review and may be purchased at Depoe Bay City Hall, 570 SE Shell Avenue, seven
days prior to the hearing.
TESTIMONY: Testimony may be submitted in written or oral form. Oral testimony will be taken during the
course of the public hearing. Failure to raise an issue in a hearing, either in person or in writing,
or failure to provide statements/evidence sufficient to afford the Planning Commission an
opportunity to respond to the issues precludes appeal to the Land Use Board of Appeals on that
issue. The comment period for written testimony expires Wednesday, October 9, 2024, 4:00 p.m.
